1. Acceptance of these Terms

By accessing or using TunnelTunnel, you agree to these Terms of Use. If you do not agree, you must discontinue use of the Services. You must have the legal capacity required under applicable law.

2. Description of the Services

TunnelTunnel provides a secure encrypted gateway between users and artificial intelligence providers. TunnelTunnel does not develop, own, train, modify or control third-party AI models. Our role is limited to securely routing communications through encryption and anonymization technologies. AI-generated content is produced solely by the respective AI provider, and TunnelTunnel cannot guarantee its accuracy, completeness or reliability.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities performed under your account.

4. Acceptable Use

You agree not to use the Services for unlawful activities, infringement of intellectual property rights, malware distribution, fraud, abuse or attempts to compromise the security of the platform.

5. Privacy and Security

5.1 Security

TunnelTunnel implements high-level encryption, anonymization, and industry-standard security measures designed to protect user communications and sensitive information.

While TunnelTunnel applies commercially reasonable safeguards, no internet-based service or security system can guarantee absolute protection against all risks. Users acknowledge that the use of any online service involves inherent security risks.

Users are solely responsible for protecting their own accounts and data. In particular, users are strongly encouraged to:

  • use a strong and unique password for their TunnelTunnel account;
  • enable additional security measures where available, including multi-factor authentication;
  • access the Services only through secure and trusted internet connections;
  • protect their devices against unauthorized access;
  • regularly delete conversations that are no longer needed, especially when they contain sensitive or confidential information;
  • maintain secure backups of important information where appropriate.

TunnelTunnel shall not be liable for any loss, unauthorized access, or disclosure resulting from weak passwords, compromised user devices, insecure network connections, user negligence, or the failure to follow reasonable security practices.

By using the Services, users acknowledge that they share responsibility for maintaining the security of their accounts and the confidentiality of the information they choose to submit.

5.2 Password, Encryption Keys and Data Recovery

TunnelTunnel uses end-to-end encryption designed to ensure that only the user can access the content of encrypted conversations.

Users are solely responsible for maintaining and securely storing their account password, encryption credentials, recovery keys, backup files, or any other authentication information required to decrypt their conversations.

TunnelTunnel does not possess, store, or have access to users' encryption keys or passwords.

Accordingly, if a user loses their password, recovery credentials, or backup, TunnelTunnel cannot recover, decrypt, restore, or access the encrypted conversations.

In such circumstances, the encrypted data shall be considered permanently inaccessible and irretrievably lost. TunnelTunnel has no technical ability to restore such data and shall bear no responsibility for any resulting loss.

Furthermore, when a user permanently deletes a conversation through the Services, the deletion is irreversible. Once deleted, the conversation is permanently erased from TunnelTunnel's systems and cannot be recovered by the user or by TunnelTunnel.

By using the Services, users acknowledge and accept the risks associated with end-to-end encryption, including the permanent loss of encrypted data resulting from the loss of passwords, encryption credentials, or backups.

6. Intellectual Property

All software, trademarks, logos, documentation and content belonging to TunnelTunnel remain the exclusive property of TunnelTunnel or its licensors.

7. AI Disclaimer

TunnelTunnel acts solely as a secure encrypted gateway between users and artificial intelligence providers.

Except for proprietary services explicitly identified as TunnelAI, which operate on TunnelTunnel's own encrypted end-to-end infrastructure using open-source AI models, TunnelTunnel does not develop, own, train, modify, supervise, or control any AI model.

For third-party AI services, TunnelTunnel provides only the encrypted tunneling technology and the infrastructure required to securely transmit communications between the user and the selected AI provider.

Due to the end-to-end encryption implemented by TunnelTunnel, TunnelTunnel cannot access, read, monitor, inspect, modify, or validate the prompts submitted by users or the responses generated by third-party AI providers.

Accordingly, TunnelTunnel does not generate, edit, review, endorse, verify, or validate any output produced by third-party AI models.

Users acknowledge and agree that:

  • AI-generated content may be inaccurate, incomplete, misleading, biased, or outdated;
  • all AI-generated outputs must be independently reviewed and verified before being relied upon;
  • TunnelTunnel makes no representation or warranty regarding the accuracy, reliability, legality, completeness, or fitness for any particular purpose of AI-generated content;
  • TunnelTunnel shall not be liable for any loss, damage, claim, or decision arising from or relating to the use of AI-generated responses.

The Services are provided for informational and productivity purposes only and do not constitute legal, medical, financial, tax, accounting, engineering, or other professional advice.

TunnelTunnel is not responsible for any decision, loss or damage resulting from reliance on AI-generated content.

8. Subscription and Billing

Paid subscriptions renew automatically unless cancelled before the renewal date. Fees are generally non-refundable except where required by applicable law.

9. Limitation of Liability

To the fullest extent permitted by the laws of Hong Kong, TunnelTunnel provides only encrypted gateway infrastructure. TunnelTunnel shall not be liable for AI-generated content, hallucinations, inaccuracies, omissions, service interruptions caused by third-party AI providers, or any damages resulting from reliance on AI-generated responses. The user remains solely responsible for evaluating and using AI outputs. TunnelTunnel's aggregate liability shall not exceed the subscription fees paid during the twelve (12) months preceding the claim.

10. Third-Party Services

External AI providers operate independently from TunnelTunnel and remain solely responsible for the operation, availability, security and content of their services. Use of those providers may also be subject to their own terms and policies.

11. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region. Any dispute shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
